The Karnataka High Court in India has ordered the release of two Nigerian men, Emeka Iwoba and Uderike Fidelis, after ruling that their arrest in Bengaluru violated constitutional rights.
However, because the pair had been living in India for over 10 years without valid visas, the court also ordered their immediate deportation back to Nigeria.
The court ruled that Indian authorities failed to tell the men why they were being arrested. In India, this is a "mandatory safeguard" that applies to everyone, not just citizens.
The men were originally picked up in 2024 on suspicion of involvement with illegal substances like MDMA and cocaine.
Regardless of the criminal case, the court found they had no legal right to remain in the country after a decade of expired documentation.
The Foreigners Regional Registration Office (FRRO) has been directed to start the removal process immediately in coordination with diplomatic officials.
