Senator Natasha Akpoti-Uduaghan has filed a counter-affidavit at the Supreme Court, urging the court to dismiss an appeal by Senate President Godswill Akpabio over proceedings at the Court of Appeal

The counter-affidavit, deposed to by a senior legislative aide, argues that Akpabio's application lacks merit and constitutes an abuse of court process.

The dispute centers on an alleged violation of the Court of Appeal Rules, which limit briefs of argument to 35 pages. Akpoti-Uduaghan's team claims Akpabio's brief exceeded this limit and failed to regularise the defect, leading the Court of Appeal to reject it.

The respondents also argue that Akpabio's grounds of appeal raise issues of mixed law and fact, requiring prior leave of court, which wasn't obtained.

They contend the appeal is incompetent and urge the Supreme Court to dismiss it, calling it a stalling tactic.

The Court of Appeal had concluded hearing on November 28, 2025, and reserved judgment.
