The Defence Intelligence Agency (DIA) must present Sheikh Sani Abdulkadir Zaria in court next Wednesday.
This follows a lawsuit filed by the cleric's lawyers, who are challenging his long detention without trial and demanding his immediate release.
The Sheikh has been held since late last year without being allowed to see his family or friends. The government claims this is for "security reasons."
Justice Lifu reminded the government that Nigeria follows international human rights rules. He ruled that no citizen should be detained indefinitely without following the law.
Lawyers for the DIA admitted he is being held by the military but could not give a solid legal reason why he hasn't been charged or brought before a judge yet.
All eyes are now on February 18, when the military agency is expected to either bring the cleric to court or explain exactly why they are still holding him.
